As a result of State ADU laws, codified in Government Code §§666310 to 66342, local agencies are required to comply with state regulations for ADUs.
What is an Accessory Dwelling Unit ?
An Accessory Dwelling Unit or ADU means an attached or a detached residential dwelling unit that provides completely independent living facilities for one or more persons and is located on a lot with proposed or existing primary residence. It shall include permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as the single-family or multifamily dwelling is or will be situated. These are also commonly known as in-law units or granny units or second units.
What is a Junior Accessory Dwelling Unit?
A Junior Accessory Dwelling Unit or JADU means a unit that is no more than 500 square feet in size and contained entirely within a single-family residence. A JADU may include separate sanitation facilities or may share sanitation facilities with the existing structure. JADUs are also referred to as interior units.
ADUs are allowed in all residential zoning districts. Residential districts in Foster City include: R-1, R-2, R-T, R-3, R-4. Residences may also be located in the C-2 and C-M districts.

ADU Information
On August 18, 2025, the City Council adopted Ordinance No. 692, which amended Chapter 17.78 (Accessory Dwelling Units) of Title 17 (Zoning) to ensure compliance with State law related to the latest regulations for accessory dwelling units.
JADU
Junior Accessory Dwelling Unit or JADU is a unit of no more than five hundred (500) square feet in size and contained entirely within a single-family residence, maintains a separate exterior entrance from the main entrance to the single-family residence, maintains an interior connection to the main living area of the single-family residence. A JADU may include separate sanitation facilities or shares sanitation facilities with the existing structure. JADU Requirements (FCMC Section 17.78.060.B):

Attached ADU
Attached ADU is an ADU that is constructed as a physical expansion (i.e., addition) of an existing single-family residence and shares at least one (1) wall with the single-family residence. Attached ADU Requirements (FCMC Section 17.78.060.C)

ADU FAQ
What are the steps to obtaining permits for an ADU?
- Fill out Building Application and ADU Neighbor Notification Form.
- Prepare your submittal
- Submit online through eTRAKiT Web Portal or in-person (in-person submittal requires four (4) sets of plans).
- Obtain a Business License (if needed) through HdL Business Support Center.
- Pay Fees through eTRAKiT Web Portal.
- Record a Declaration of Restrictions at the County Recorder’s Office.
- Permit is issued. Begin construction.
- Schedule for a building inspection through eTRAKiT Web Portal.
- Receive a Certificate of Occupancy.
What are the parking requirements?
Shall not exceed 1 parking space permit unit or bedroom whichever is less.
No parking required if one of the following conditions are met:
- ADU located within ½ mile of public transit,
- With approved car share with issued Foster City Business License,
- Proposed ADU is a studio only (no additional bedrooms),
- ADU is located in a architecturally and historically significant area, or
- When ADU is part of the proposed or existing primary residence or accessory structure. (FCMC Section 17.78.080).
What if my ADU application is rejected?
If the City disapproves an application for an ADU or JADU, the Building Division shall return in writing a full set of comments to the applicant with a list of items that are defective or deficient and a description of how the application can be remedied by the applicant. (Section 17.78.090.B)
Is there any funding available to help me build my ADU?
Coming soon! The City is implementing a financial incentive program for homeowners who agree to restrict their ADU/JADU to lower-income households for ten years, as well as additional incentives for those who rent their ADU/JADU to a household with special needs. Stay tuned to learn more about this program.
Can I build an ADU/JADU on an institutional, religious, or school site?
Yes, we have amended the zoning code to allow for this type of use on certain properties. Contact the Planning Department to learn more and to learn about incentives for building ADUs and JADUs on these sites. Schedule a meeting or contact Planning to learn more.
What does a State-exempt ADU mean?
An applicant may choose to submit a State-exempt ADU project if it meets the criteria and requirements specified in Government Code Section 66323. No additional standards may be applied to State-exempt ADUs and JADUs.
Are there any rebates that can help me with my ADU?
Here are some rebates that you can apply for:
- Solar Rebate Program - The Residential Solar PV (solar photovoltaic technology) Incentive Program provides a one-time, $1,000 incentive to residents who choose to install Solar PV on their homes (LINK).
Definitions added to the Code
“High-Quality Transit Corridor”
“High-quality transit corridor” means a corridor with fixed route bus service with service intervals no longer than fifteen minutes during peak commute hours.
“Objective Standards”
“Objective standards” means standards that involve no personal or subjective judgment by a public official and are uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official prior to submittal.
"State Exempt Units"
“Tandem Parking”
“Tandem parking” means that two or more automobiles are parked on a driveway or in any other location on a lot, lined up behind one another.
