FAQ - Sidewalk Information

Question: Who is responsible to fix the sidewalk?

Answer: Existing state law and City ordinance places the responsibility for maintenance of sidewalks adjacent to private property on the property owner. At the June 4th, 2001 City Council meeting, the Council adopted an ordinance that clarifies the property owner's responsibility to third parties who suffer injury or damage because of the property owner's failure to maintain the sidewalk in a safe and secure condition.

It is important that property owners understand their responsibilities regarding sidewalk maintenance. Property owners are encouraged to inspect their sidewalks regularly and to act promptly to have them repaired if necessary to avoid injuries and costly litigation.

For further information about this ordinance or to obtain an encroachment permit for sidewalk repairs, please contact Foster City's Public Works Department.
